Terms and Conditions

Governing Law

This agreement is governed by and constructed in accordance with the laws of Queensland. You irrevocably and unconditionally submit to the non- exclusive jurisdiction of the Courts of Queensland. If any provision of this agreement is found to be invalid or unenforceable by a Court of law, such invalidity or unenforceability will not affect the remainder of the provisions of the agreement which will continue in full force and effect.

Sale Terms

Savings are based on normal RRP, any floor stock sold is sold as is condition and only carries the statutory 1 year warranty. No finance is available on sale prices and no orders, holds or lay buys. Discounts are only available on new orders and offers are NOT AVAILABLE in conjunction with any other offer, unless otherwise stated.

VIP Cards Holders

White VIP

  • Spend $3000 or more on any in store purchase across any of our stores to become eligible for a VIP member
  • Customers will be notified in advance of any in store promotions/sales – opportunity to see sale items in store before the public

We are unable to process your order until a 30% deposit has been paid (unless otherwise stated).


Please ensure that you have settled any balance owing with the Eureka Street Furniture store you purchased your items from prior to scheduled delivery. Personal cheques must be cleared 24 hours prior to delivery. Unfortunately our contract drivers are not able to accept payments during delivery.

Conditions of Sale

Please be advised that our timber furniture is made from natural timbers, and as such pieces are unique. If the exact shade or grain is important to you, please inspect the product before delivery, as refunds will not be given and any exchanges will incur a cost to you.


All warranties given or implied are ex-factory and, due to the nature of all solid timber, cover workmanship only. This means if you have a warranty issue or claim the goods must be returned to the place of purchase before we can assess your claim.

Goods On Order

Dates quoted for delivery of goods are approximate only at the time of ordering and may vary due to circumstances beyond our control. You will be advised as soon as your goods are ready for delivery.


Cancellations and refunds will not be given for change or mind, if goods do not fit or if there is a delay with the ETA. In the event that there is a legal reason for a refund/cancellation of a sale, refunds will only be given in accordance with the guidelines issued by the Australian Consumer Law. A minimum of 20% of the invoiced price may be deducted from any discretionary refund or lay-by cancellation to cover administration costs and this is at the complete discretion of management. Special orders require a non-refundable deposit of 50% of the invoice price.

Ownership of Goods

Goods marked as "sold" on behalf of a customer after receipt of deposit or lay-by payment shall remain the property of Eureka Street Furniture Pty Ltd until the invoiced price is paid in full.

Lay-By Arrangements

A deposit to the value of 30% of the total purchase price is required to begin a lay-by.

Payments are to be made fortnightly. There are two types of lay-bys (4 weeks and 3 months). Stock will be held and allocated for 4 week lay-bys.First available stock will be given for 3 month lay-bys (note there may be delays).  Failure to complete payments in the specified time makes the goods, any payments made and the deposit liable for forfeiture if considered reasonable in accordance with the Australian Consumer Law.

Lay-bys should not exceed a 3 month period.  A lay-by can be cancelled by the purchaser but may result in forfeiture of some moneys paid if it is deemed reasonable in accordance with the Consumer Law. Keeping in mind that furniture is a large item which incurs considerable costs for freight and storage.  If lay-bys are not picked up by the specified date a storage fee of $30 per week may be charged.

Lay-by Arrangements should be by regular, fortnightly repayments over a three-month period but this period may be extended at the discretion of the directors.

Delivery of Goods

The approximate delivery date we give you is an estimate based on current manufacturing and shipping times. This should be treated as a guide only. Please contact the Eureka Street Furniture store you purchased the item from should you require an updated estimate.

If delivery of goods is unsuccessful on the day organised by the customers, a further two-way charge will be payable by the customer for the second delivery. Our carriers agree to deliver to the customers address only. It is at the customer’s expense if goods do not fit into the property or cranes, etc are required to achieve access. Sales staff must be advised at time of sale/booking delivery if access problems are anticipated.

Refunds will not be given if goods do not fit.

Delivery of Online orders

When an online order is processed, a member of our team will contact you to arange the delivery/colletion of your goods. Stock that is showing as in stock, is generally available for delivery within 1 week. Stock that is showing as "On Order" will take longer. You will be contacted and advised of the ETA of your goods. You will then also be contacted once the goods arrive and a delivery/collection date arranged.

Please note that there may be variances between the colours of timber and leather in store and depicted on our online store due to natural characteristics of the product.

Eureka's retail staff are not required to help customers load goods into their own vehicles. Customers picking up goods should bring assistance with them.

Our warranty does not cover the delivery of goods.

Quotes on deliveries are estimates only. If the destination is further than anticipated or access is difficult, additional costs may be incurred.

Discount Offers

Please be aware that all discount offers are OFF Recommended Retail Price (RRP) Only. Offers are not transferable or redeemable for cash.

Discounted Stock and Floor Stock

Please be aware that if an item is sold off the floor or is discounted more than 30%, it is sold "as is". Please check all goods carefully to ensure you are happy with the state they are in either at purchase or upon delivery in the case that goods are unseen. All ex-display or discounted stock is sold with a limited 12 month warranty which covers defects not known or visible at the time of purchase. All other defects are not covered.

Manufacturer's Warning

The natural oils in teak timber furniture can mark some floor coverings. Please take precautions if you are concerned or ask our staff for advice.

Please be advised that all timbers and leathers are natural products and as such require on-going care. Timbers require waxing and leathers require conditioning with the recommended leather care kit. All warranties are contingent upon products being cared for in line with this manual.

Outdoor and Patio Furniture

Eureka Street Pty Ltd does not sell furniture designed to be subjected to the elements. All furniture sold as out door or patio furniture requires a roof to protect the furniture from the elements. Exposure to the elements may damage the product and will void the warranty. Please ensure all furniture sold as outdoor or patio furniture is sheltered from the elements and has a roof covering the furniture at all times. Further to this sunlight will fade timber and fabric over time. Fading caused by exposure to sun light is not covered by warranty. To avoid fading please do not place furniture in direct sun light.

Trip Hazard

Warning furniture may become a tipping hazard. It is strongly recommended that furniture be anchored to the wall. This is the best practice for furniture items, such as (but not limited to):

  • Bedroom storage over 500mm tall, including chests of drawers, tallboys, dressers, wardrobes and bedside tables
  • Bookcases and libraries over 600mm tall
  • Storage cubes and modular units over 600mm tall (combined height)
  • Entertainment units over 500mm tall)
  • Buffets and hutches over 500mm tall
  • Filing cabinets or similar over 500mm tall

We strongly encourage our customers to secure all furniture to the wall. Please note that Eureka Street Pty Ltd accepts no liability in relation to a customers failure to secure their product to the wall.

To ensure your furniture maintains its showroom appearance, avoid use of silicone based domestic sprays and use only natural based products as advised by sales staff.

Marble like all natural stone is porous, meaning it has very small holes or pores throughout its surface where air and liquid can pass through. Even with a sealant, marble has potential to be effected by spills etc and great care must be taken to keep the surface clean. Eureka recommends the use of Guardsman Stone Seal and Protect or some other non-silicone based product to help maintain maximum surface protection. All furniture needs to be maintained with proper upkeep and marble is no exception. The manufacturer’s warranty will be considered void if damage is caused to the marble by corrosive materials, such as acids, solvents, dyes and inks.

General Warranty

Unless otherwise stated all purchases from Eureka Street Furniture are covered by a one (1) year warranty from the purchase date. Eureka Street offers to rectify, repair or replace any defects in material and workmanship in our whole range of products.

This warranty does not cover surface scratches, dents, chips, marks, accidental breakages, deliberate or negligent damage and normal wear and tear.

Extended Warranty

In the case of extended warranties purchased at the point of sale. Normal warranty terms and conditions will apply with the exception of the extended date from date of delivery.

Leather and Fabric Warranty

All leather and fabric is covered by a one (1) year warranty unless otherwise stated.

Rattan Seating Warranty

Rattan seats are for sitting on only. If you apply too much pressure to a specific area of the rattan seat it may break. Such a break will be classed as misuse and not be covered by any warranty express or implied.

What Does my Warranty Exclude?

The Eureka Street Furniture Warranty Program specifically excludes claims for:

  • Products used in commercial, rental trade, institutional or other nonresidential use
  • The normal and expected settling of soft filling such as polyester fibre and leather
  • Leather and timber grain variation, colour variation, wrinkling, markings, and scars resulting from the natural features of the product
  • Damage or degradation of timber, leather and fabric coverings not properly maintained; that is, the regular removal of dust and dirt by appropriate means and the application of endorsed cleaning and care nourishing products as instructed at time of sale
  • Damage to timber, leather or fabric coverings due to the application of chemicals, cleaners or conditioners not endorsed by Eureka Street Furniture
  • Discolouration of timber, leather or fabric coverings resulting from exposure to direct sunlight, extreme heat or similar conditions
  • Damage to leather or fabric coverings caused by the transference of perspiration, body oils or the corrosive ingredients contained in personal care products such as hair gels and skin creams
  • Surface scratches, dents, chips, marks, accidental breakages, normal wear and tear or damage resulting from misuse or abuse
  • Damage incurred during handling and transportation of the product by the customer or their contractor
  • Damages resulting from dye transfer from rugs, cushions, jeans and other clothing
  • Furniture repaired by contractors not endorsed by Eureka Street Furniture
  • The cost of transportation from the purchaser to Eureka Street Furniture or its agents, if the claim is not covered by the standard warranty conditions
  • damage caused to a product or person resulting from use of the product by a person who is over 120 Kg's

Damage to Timber

Avoid leaving wet cloths, glasses etc on lacquered surfaces, these will breakdown the lacquer. Damage of this nature can be fixed but at considerable extra cost. Note: This kind of damage is not included in any Eureka Street Furniture Warranties.

When calling regarding a warranty issue you will require your Invoice Number, so please ensure that you store this in a safe place.

You must make your request for service immediately following the discovery of any alleged defect. To make a claim under our warranty you must be able to prove when you purchased the product. The easiest way to do this is through your original proof of purchase (invoice, receipt, etc).

Once you have raised your issue with the appropriate store we may arrange for a Eureka Street Furniture Customer Service team member or contractor to visit your home. We may also require you to bring back the goods to the place of purchase to be assessed.

The team member or contractor will assess your furniture to verify that the product presents manufacturing defects. More than one inspection may be required.

If your claim is valid Eureka Street Furniture will, at its choice, repair or replace the defective product.

We remind our customers that softening of cushioning should be expected as a result of normal use and is not to be confused with the loss of resilience.

The Eureka Street Furniture warranties are not transferable and service is available only to the original purchaser.


We reserve the right to correct errors in pricing online and in-store.

Other rights

The benefits given by our warranty are additional to other rights and remedies that you may have under law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Important Notes for Recliners

Do not allow children to play on motion sofas and armchairs. Before using any of the mechanisms ensure the person using the chair is correctly seated. Precautions should be taken by people with lumbar medical conditions and/or pregnant women.

A Note of Advice for Lounges and Sofas

At Eureka Street Furniture we want to ensure you enjoy your new sofa for many years to come.  Whilst we can’t tell you how to sit on your sofa, we would like to kindly advise that how you sit on your sofa can actually affect its performance and your warranty.

All seating foams are designed to absorb the seated weigh loads in the centre of the cushion, sitting or laying on the edges and sides of the cushion can cause the breakdown of the foams causing them to flatten and lose their density, firmness and form.

Natural settlement at the point most used will prevail and repeated or continual pressure put on these areas of your seating cushions can cause uneven settlement that is not covered under your seating warranty.

Sofas that have soft fill or feather based cushions require regular shaping (e.g. plumping cushions) to maintain optimal appearance.


Measurements are not binding in detail and are only an indication of size, please check measurements in store.

Gift Cards

Goods and credit against any purchases made in any eureka showroom and is not exchangeable for cash. The laws in respect to gift cards vary from state to state. If there is a conflict between the expiry date on the gift card and the law of the state the gift card was generated, the state law will prevail. Gift Cards are available for purchase online and instore but can only be used in one of our 26 showrooms.


Finance Offer not applicable to Clearance Lines, Discontinued Stock, End of Line Clearance. Finance not applicable to stock with discounts of 40% off RRP or more. No Finance on Special Orders. If you are paying us for the first time please call and confirm our account details over the phone before you make a payment. We have no intention of changing our bank accounts. If you ever receive correspondence from us asking you to update our bank account details please disregard the correspondence and call us immediately. Failure to adhere to this instruction will result in you/your business being held liable for any loss suffered.

Quotes and Invoices

I agree that the information recorded above is a true record of the sale and understand the following: All goods are covered by a statutory 12 month warranty unless otherwise noted. Payment and Collection of sale goods

All goods purchased at a discount of 50% or greater must be paid for in full at the time of purchase. They must also be collected/delivered as soon as they are available. Failure to have your goods delivered/collected once available may result in storage fees being charged.
